Resumo Este artigo explora a diferença entre estrutura e semântica como chave explicativa para as reivindicações da teoria dos sistemas acerca de suas vantagens como au-todescrição sociológica da sociedade moderna. O argumento central é o de que a teoria dos sistemas se utiliza dessa diferença para explicar como estruturas sociais desencadeiam semânticas específicas. A relação entre estrutura social e semântica é mediada pela complexidade das estruturas. Nesse sentido, a teoria dos siste-mas se distingue de teorias pós-modernas, do discurso ou do poder. Em lugar de constatar a pluralidade de narrativas e tirar daí consequências muitas vezes pre-cipitadas acerca da contingência, como a centralidade do poder na reprodução social (um primado do " político "), a teoria dos sistemas insiste em um primado do social que aponta para as raízes estruturais da visibilidade dessa contingência. Isso torna a sociedade capaz de refletir sobre suas possibilidades a partir de uma teoria adequada à sua própria complexidade. Palavras-chave: Teoria dos sistemas. Complexidade. Estrutura/semântica. Zusammenfassung: Dieser Artikel befasst sich mit der aktuellen Debatte über den transnationalen Konstitutionalismus und den theoretischen Überlegungen über die Möglichkeiten einer internen Politisierung der transnationalen Governance. Nach einer Zusammenfassung der Debatte über die Transnationalisierung des Rechts und die Entstehung von fragmentierten Formen transnationaler Governance, versuche ich neue Formen im Verfassungsrecht innerhalb der fragmentierten Rechtsregime der Global Governance zu beschreiben. Im Anschluss daran untersuche ich die von einigen Rechtsgelehrten vertretene Annahme, auf der Möglichkeit einer internen Politisierung des Rechtsdiskurses zu beharren, um die sogenannte Expertenherrschaft im transnationalen Recht in Frage zu stellen. Unter Bezugnahme auf Claude Leforts sozialtheoretische und politisch-philosophische Überlegungen beschreibe ich anschließend das, was ich als soziale Bedingungen einer Politisierung des Rechts " bezeichne. Mein Argument dabei ist, dass die Möglichkeit, die Politik des Rechts in irgendeiner Weise zu verwirklichen, auf Merkmalen beruhen muss, die für die politische Konstitutionalisierung des Rechts typisch sind, aber in der heutigen transnationalen Governance nicht vorhanden zu sein scheinen. ABSTRACT: This essay addresses the ongoing debate on transnational constitutionalism and the theoretical assumptions related to the possibilities of internal politicization of transnational governance. After reconstructing the debate on the transnationalization of law and the emergence of fragmented forms of transnational governance, I engage on the description of emerging forms of constitutional law within the fragmented legal regimes of global governance. After doing that, I explore the assumption exposed by some legal scholars, which insists on the possibility of an internal politicization of legal discourse as a way to challenge the so called " rule of experts " in transnational law. Drawing on social-theoretical and political-philosophical formulations of Claude Lefort, I will then address what I call the social conditions of the politicization of law. My claim is that the very possibility of carrying out a certain politics of law depends on features, typical of the political constitutionalization of law, which do not seem to be present in transnational governance

This article attempts to analyze, with a special focus on the modern society's legal dimension of social integration, the central points of disagreement between the Jürgen Habermas's theory of discourse and the Axel Honneth's theory of recognition. The "communitarianist" critic raised by Honneth against Habermas forces a reformulation of the traditional theory of modernization in the sense of a cultural theory of modernity. Within this framework, we have to face the fact that the social changes, which led our societies to the institutionalization of the legal principle of equality, ought to be seen as the result of processes of social struggle founded on moral interpretations. Although this new approach tends to change many suppositions of a critical theory itself, we try to defend that Honneth's theory of recognition keeps a normative core that can still furnish a critical theory of society.

This article approaches the Albrecht Wellmer's critic to moral theories which are based on universalistic principles. Our starting point is his attempt to review the very idea of moral universalism. Afterwards, we lean over his radical critics to all kinds of principiological moral universalism, whose main example, on his theoretical context, is the Jürgen Habermas's Ethic of Discourse. Finally, we try to grasp some possible alternatives, overall the possibility of elaboration of moral theory on the basis of a theory of social recognition.
